A. INTRODUCTION

By using and/or visiting any section (including sub-domains) of the Betify.com website or any other websites or applications that we own (the “website”) and/or registering on the website, you agree to be bound by (i) these Terms and Conditions; (ii) our Privacy Policy; (iii) the Rules applicable to our sports betting, virtual sports, Jackpot, Casino or other gaming products as further referenced at paragraph 2 below (together the "Terms"), and are deemed to have accepted and understood all the Terms and Rules.

Please read the Terms carefully and if you do not accept the Terms, do not use the website. The Terms shall also apply to all telephone betting and betting or gaming via mobile devices including downloadable applications to a mobile device.

Where you play any game, or place a bet, using the website, you will be deemed to accept and agree to be bound by, the Rules which apply to the applicable products available on the website. The Rules can be found in the "How to play" Section.

We may need to change the Terms from time to time for a number of reasons. All changes will be published on the website. If any change is unacceptable to you, you should cease using the website and/or close your account. If you continue to use the website after changes come into effect, you will be deemed to have accepted those changes.

Reference to "Betify", "We", "Us" or "Our" is reference to Betify.com’s corporate entities.

Reference to "you", "your" or the "customer" is reference to any person using the website or the services of Betify and/or any registered customer of Betify.

Reference to "Username" is reference to any person who has registered on our website by using Phone number.

You are responsible for determining whether you're accessing and/or using the website in compliance with applicable laws in your jurisdiction and you warrant that gambling is not illegal in the territory where you reside.

B. YOUR Betify ACCOUNT

Application

1.1 All applicants must be over 18 years of age to place a bet or register with Betify. Betify reserves the right to ask for proof of age from any customer and suspend their account until satisfactory documentation is provided.

1.2 All information supplied when registering with the site MUST be accurate and complete in all respects.

1.3 Betify may confirm a customer’s address by posting an address verification letter to the customer.

1.4 By accepting the Terms and/or registering to use the Website you agree that we may conduct identification, credit and other verification checks as required.

1.5 As part of the registration process, we may supply your information details to authorised credit reference agencies to confirm your identity.

1.6 Customers may open only one Betify account. Should we identify any customer with more than one account, we reserve the right to close or suspend such customer and withhold any winnings or bonus payments.

1.7 Customers must keep their registration and account details up to date.

Account Details

2.1 Betify allows all its customers to choose their own username and password combination. Customers must keep this information secret and confidential.

2.2 Bets will stand if your username and password have been entered correctly, subject to there being sufficient funds in the account.

2.3 If you feel a third party is aware of your username and/or password you should change it immediately via the Website.

2.4 You are responsible for all transactions where your name and account number or username are correctly quoted.

2.5 Cardholder details and any other sensitive data should never be sent to us by unencrypted email.

2.6 The current balance and transaction history of your account may be viewed at any time once you have logged into your account.

Personal Details

3.1 Your personal information is processed in accordance with our Privacy Policy.

Suspension and Closure

4.1 If you want to close your account, please contact us. Any negative balance on your account will fall immediately due and payable to Betify.

4.2 Betify reserves the right to close or suspend your account at any time and for any reason, including fraud, unlawful use, unfair use, regulatory requests, or suspected prohibited conduct.

4.3 If Betify closes or suspends your account for any such reasons, you shall indemnify and hold Betify harmless for all claims, losses, liabilities, damages, costs and expenses incurred.

4.4 Betify reserves the right, at its sole discretion, to restrict, limit, suspend, or otherwise take action in relation to any betting activity or account usage.

Platform Utilization

5.1 You must be a resident of Nigeria to be eligible to register, use, and/or benefit from the Betify platform or its services.

5.2 You must be within the territory of Nigeria at the relevant time to be eligible to use our platform.

5.3 If you are found not to be a resident of Nigeria and/or accessing services outside Nigeria, Betify reserves the right to close your account and withhold any winnings.

C. YOUR FINANCES

Deposits and Bets

1.1 You must confirm your account information to receive your first deposit.

1.2 You may only bet with cleared funds held in your account.

1.3 By depositing funds into your account, you direct us to hold them for the purpose of placing sporting and gaming stakes and settling applicable fees or charges.

1.4 All funds that we hold for you are held in separate designated customer bank accounts to be used solely for the stated purpose.

1.5 You agree that we may retain any interest which might accrue on monies held in your Betify account.

1.6 No credit will be offered by any employee of Betify, and all bets must be supported by sufficient funds.

1.7 Unless otherwise stated, all examples given on the Website are given in NGN.

1.8 Once a currency is selected, funds are deposited, wagered and winnings paid in that currency.

1.9 Betify may withhold and/or retain any amounts earned or received as a result of unauthorised use of the Website.

Withdrawals

2.1 Betify generally only allows withdrawals to bank account names that match the confirmed name on the Betify account.

2.2 Withdrawals can be processed by clicking 'Withdraw' on the Website, subject to sufficient funds.

2.3 If the value of a deposit is not played through in full before withdrawal, Betify reserves the right to charge reasonable costs.

2.4 Withdrawals must be made to individual bank accounts in the same name associated with the Betify account. Withdrawals to corporate accounts are prohibited.

Other

3.1 If we incur any charge-backs, reversals or other charges in respect of your account, we reserve the right to charge you.

3.2 We may set off any positive balance on your account against any amounts owed by you to Betify.

3.3 You are responsible for reporting your winnings and losses to tax and/or other authorities.

3.4 Internet gambling may be illegal in the jurisdiction where you are located. Any bets accepted from such jurisdictions will stand.

D. BETTING PROCEDURES

Placing Bets

1.1 Betify reserves the right to decline all or part of any bet requested at its sole discretion.

1.2 We only accept bets made online, including via mobile device or downloadable applications.

1.3 It is the customer’s responsibility to ensure details of bets are correct. Once placed, bets may not be cancelled or changed by the customer.

1.4 Your funds will be allocated to bets in the order they are placed.

Bet Confirmation

2.1 Bets will not be valid if there are insufficient funds in your account.

2.2 A bet will only be valid once accepted by Betify’s servers and issued a unique transaction code.

2.3 If bets are placed via credit or debit card, they are not valid until payment has been received in full.

2.4 Should a dispute arise, the Betify transaction log database will be the ultimate authority.

2.5 Customer complaints or disputes regarding bet acceptance, settlement or resettlement must be submitted within 30 days.

Offers

3.1 All customer offers are limited to one per person, family, household address, email address, telephone number, mobile device, application download or shared computer.

3.2 Where promotion terms are breached, Betify reserves the right to reclaim bonuses, void bets, or levy an administration charge.

3.3 Betify reserves the right to withdraw any offer to any customer or group of customers at any time.

3.4 Betify reserves the right to amend or cancel any customer offer or promotion at any time.

Settlement and Payouts

4.1 All bets are subject to the Rules for the relevant sport, market or game.

4.2 Betify reserves the right to suspend markets and/or cancel any bet at any time.

4.3 The "Potential Win" calculation is for information purposes only.

4.4 If a customer includes a non-runner or void selection in a multiple bet, the bet will be settled on the remaining selections.

4.5 Winnings from settled bets are added to the balance of your betting account.

4.6 Betify may withhold payment and declare bets void where event integrity, price manipulation or match-rigging is suspected.

4.7 Betify may void bets or withhold returns where there is evidence of a series of related bets by the same individual or syndicate.

4.8 For events where there is no official "off", the advertised start time will be deemed the off.

4.9 Bets on Live events are subject to a delay during bet placement.

4.10 If we cannot validate the outcome of a market, all bets will be void unless settlement is already determined.

4.11 If any selection from a multiple bet is settled as lost, the entire bet is lost.

4.12 Where a customer gives ambiguous instructions, Betify reserves the right to split the stake or void the bet.

Errors

5.1 Betify will not be liable for errors in respect of bets or wagers.

5.2 Incorrect Price: where an Obvious Error is identified, Betify reserves the right to void the bets.

5.3 Incorrect Fixture: where an incorrect player or team is quoted, all bets will be void.

5.4 Incorrect Market: if an incorrect market is quoted, bets placed on that market will be void.

E. USE OF THE WEBSITE

Information and Content

1.1 Information accessed by you on the Website is for your personal use only and must not be distributed or commercially exploited.

Your Equipment

2.1 Your computer equipment, mobile device and internet connection may affect the performance of the Website.

2.2 Betify will not be responsible for damage to or loss of data from mobile devices or related charges incurred while using the software.

Fair Use

3.1 The Website and Betify products may only be used for placing bets and/or gaming products.

3.2 You must not use the Website for any illegal, defamatory, abusive, obscene, discriminatory, fraudulent, dishonest or inappropriate purpose.

3.3 Betify will seek sanctions against customers involved in fraudulent, dishonest or criminal acts.

Software and Technology Issues

4.1 Certain products may require software downloads or third party terms and conditions.

4.2 You may only use software made available via the Website for the purpose of using products on the Website.

4.3 We grant you a personal, non-exclusive, non-transferable right to use relevant software for the sole purpose of using products on the Website.

4.4 Betify shall not be liable if the Website is unavailable at any time or for any period.

4.5 You must not misuse the Website by introducing viruses, Trojans, worms, logic bombs or other harmful material.

Third Party Content

5.1 Betify receives feeds, commentaries and content from suppliers. Third party terms may apply.

5.3 Betify does not allow employees or connected persons to bet on markets where a third party service provider provides a service to Betify.

Errors

6.1 Betify will not be liable for errors in respect of bets.

6.2 Incorrect Price: where an Obvious Error is identified, bets may be settled at the Betify revised price or voided where applicable.

6.3 Incorrect Count/Line/Spread/Handicap/Total: bets may be settled at the revised count, line, spread, handicap or total, except where voiding applies.

6.4 Where there is sufficient time before an event starts, Betify may contact the customer and allow cancellation at its discretion.

6.5 Incorrect Fixture: where the wrong player or team is quoted, all bets will be void.

6.6 Wrong Participant: bets placed on a wrong participant will be void.

6.7 Late Bets: pre-event bets inadvertently accepted after an event has started may stand or be voided depending on the circumstances.

6.9 Obvious Error - Maximum Winnings: the maximum amount which can be won for a bet placed where there is an Obvious Error and revised price is USD 5,000 or its equivalent, unless otherwise stated.

Other

7.1 Betify actively monitors traffic to and from the Website and may block access where automated or robotic activity is detected.

7.2 Betify reserves the right to restrict access to all or certain parts of the Website in certain jurisdictions.

7.3 Betify may alter or amend the products offered via the Website at any time.

7.4 All or part of the Website may be unavailable due to maintenance, alteration or amendment.

To the maximum extent permitted by applicable law, Betify shall not be held liable for any loss, damage, claim, or expense incurred as a result of use of, or reliance upon, information provided by the AI assistant.

By interacting with the AI assistant, you acknowledge and accept these limitations.

F. OUR LIABILITY

Betify does not accept any liability for damages, liabilities or losses arising out of or in connection with the Website or its content.

While Betify endeavours to ensure that the information on the Website is correct, Betify does not warrant the accuracy or completeness of the information and material on the Website.

Betify’s total aggregate liability to you under or in connection with these Terms and Conditions does not exceed: (a) the value of the bets placed in respect of the relevant bet or product; (b) the amount of applicable monies misplaced by us; or (c) USD 5,000 or its equivalent in respect of any other liability.

Betify shall not be liable for loss of profits, business, revenue, opportunity, data, goodwill, reputation, or any special, indirect or consequential losses.

G. OUR INTELLECTUAL PROPERTY RIGHTS

The contents of the Website are protected by international copyright laws and other intellectual property rights. The owner of these rights is Betify, its affiliates or third party licensors.

All product and company names and logos mentioned on the Website are trademarks, service marks or trading names of their respective owners.

No part of the Website may be reproduced, stored, modified, copied, republished, uploaded, posted, transmitted or distributed without our express prior written consent.

If you upload material or content to the Website, such User Content will be considered non-confidential and non-proprietary, and Betify has the right to use, copy, distribute and disclose it for any purpose.

Any commercial use or exploitation of the Website or its content is strictly prohibited.

H. OTHER PROVISIONS

These Terms and Conditions, the Privacy Policy, Cookies Policy and any related documents constitute the entire agreement between the parties.

No delay, failure or omission in enforcing any right or remedy shall be deemed a waiver of that or any other right or remedy.

The rights and remedies provided by these Terms and Conditions are cumulative and do not exclude any other rights or remedies available in law.

If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

You shall execute all documents and do all further acts reasonably required by Betify to give full effect to these Terms and Conditions.

Nothing in these Terms and Conditions shall create a partnership, joint venture or principal-agent relationship between the parties.

Betify shall not be liable for delay or failure to perform obligations due to events beyond its reasonable control.

Betify may assign, transfer, charge, sub-license or otherwise deal with these Terms and Conditions or subcontract its rights and obligations.

Any notice under these Terms and Conditions must be in writing and in English.

The Appendices, Privacy Policy, and any related rules or documents form an integral part of these Terms and Conditions.

I. COMPLAINTS, DISPUTES, GOVERNING LAW AND JURISDICTION

If Betify is unable to settle the dispute, Betify will refer the dispute to an arbiter, whose decision will be final, subject to full representation given to all parties involved.

Settlement of bets on American sports will be based on statistics and results provided by each sport's governing body.

These Terms and Conditions and any dispute or claim arising from them shall be governed by and construed in accordance with the laws of Nigeria.

By accepting these Terms and Conditions and/or placing bets or wagers, you agree that the courts of Nigeria shall have exclusive jurisdiction.

BETTING PROVISIONS

Sports and Special Event Betting

We accept bets/wagers for sporting and other special events advertised on the Website. All such bets/wagers are subject to the rules applicable to each sport.

The result of a match or event will be determined on the day of its conclusion for betting purposes, subject to confirmation by the relevant sport's governing body.

If the venue for a sporting event is changed, all bets placed based on the original venue will be void and stakes refunded, unless otherwise stated.

Minimum bets amount

The minimum bet amount for each order is NGN 10.

Maximum Winnings

The maximum winnings for each bet is NGN 200,000,000.

The Maximum payout on Games is up to NGN 1,000,000.

The daily maximum potential winnings per customer in any 24-hour period is capped at NGN 300,000,000.

Related Contingency Betting

Multiple bets which combine different selections within the same event are only accepted where the specific combination is permitted as a Bet Builder or a specific market type.

A Related Contingency bet is when one selection affects the rest of the bet, for example a multiple bet with Manchester United to win 1-0 and Manchester United to win in 90 minutes.

Related Contingency bets which are not covered by Bet Builder are not accepted under any circumstances. Any related bets accepted in error will be settled as split stake single bets.

This also applies when the related parts of a bet are resolved at different times but still within the same tournament.

In the case of all multiples including selections with related outcomes, if a bet is taken inadvertently Betify reserves the right to void part of or the whole of the bet.
